Terms and Conditions
Effective date: May 11, 2026. These Terms and Conditions govern your access to and use of McWritely services.
1. Agreement to Terms
By accessing or using McWritely websites, desktop applications, APIs, and related services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Services.
2. Eligibility and Accounts
- You must be legally capable of entering into a binding agreement.
- You are responsible for maintaining account credentials and security.
- You are responsible for activities that occur under your account, whether or not authorized by you.
- You must provide accurate information and promptly update account details when they change.
3. Subscriptions, Billing, and Renewal
- McWritely works only with an active paid subscription.
- Subscriptions are billed in advance on a monthly recurring basis.
- Billing is processed by Stripe. By subscribing, you authorize charges according to your selected plan and applicable taxes.
- Unless canceled before renewal, subscriptions automatically renew for successive billing periods.
- You can manage, downgrade, or cancel through the billing/account portal. Cancellation typically takes effect at the end of the current paid period unless required otherwise by law.
4. Refunds
Except where required by applicable law, payments are non-refundable and partial subscription periods are not prorated. Where a mandatory legal right of withdrawal or refund applies, that right is preserved.
5. Acceptable Use
You agree not to:
- Use the Services for unlawful, fraudulent, or deceptive purposes.
- Interfere with or disrupt the integrity, security, or performance of the Services.
- Reverse engineer, decompile, or attempt to extract source code, except to the extent such restriction is prohibited by law.
- Circumvent usage controls, payment obligations, or technical limitations.
- Submit or distribute content that infringes intellectual property rights or violates applicable law.
6. User Content and Input
McWritely does not collect or store rewrite input or output text. Because this content is not collected or stored by McWritely, you do not grant McWritely a content license under these Terms.
You represent that you have all rights and permissions needed to submit content and that your content does not violate law or third party rights.
7. Intellectual Property
The Services, including software, design, trademarks, logos, documentation, and other materials provided by McWritely, are owned by McWritely or its licensors and are protected by intellectual property laws. Except as expressly permitted, no rights are granted to you.
8. Service Changes and Availability
We may modify, suspend, or discontinue part of the Services at any time, with or without notice, including to improve functionality, security, or compliance. We do not guarantee uninterrupted or error-free operation.
9. Termination
We may suspend or terminate access if you violate these Terms, create legal or security risk, fail to pay required fees, or where otherwise permitted by law. You may stop using the Services at any time and cancel your subscription through your account settings.
10. Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation.
11. Limitation of Liability
To the maximum extent permitted by law, McWritely and its affiliates, officers, employees, and licensors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business interruption.
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Services and these Terms will not exceed the amount you paid to McWritely for the Services during the 12 months before the event giving rise to liability.
12. Indemnification
You agree to defend, indemnify, and hold harmless McWritely and its affiliates, officers, employees, and licensors from and against claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of your use of the Services, your content, or your violation of these Terms or applicable law.
13. Governing Law
These Terms are governed by the laws applicable to the McWritely operating entity, excluding conflict-of-law rules, unless applicable consumer protection law in your jurisdiction requires otherwise.
14. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms and revise the effective date above. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
